1. INTRODUCTION
The website www.lapinkids.com is an electronic shop (e-shop) created and operated by the company under the trade name "ST. PAPAIOANNOU INDUSTRIAL AND COMMERCIAL SOCIETE ANONYME OF CHILDREN’S CLOTHING AND RELATED ITEMS" and under the commercial title "LAPIN HOUSE" with the Tax Registration Number (VAT No.) 094532890, Tax Office of Public Limited Companies of Athens, with registered office at 4 Stilianou Gonata str., Peristri, Attica (hereinafter referred to as "Company"), for the presentation and sale of its products through Internet. The use of the e-shop requires acceptance of each and all of terms and conditions set forth below (hereinafter referred to as "Terms) and please make sure you read them carefully at every visit and use of our e-shop. In particular, you should be aware that using of our e-shop constitutes your full and unconditional acceptance of these Terms, provided that you complete your order; thus it's presumed your explicit and unconditional acceptance, and your legal capacity.
The Terms shall be governed by the laws of Greece and in particular by such effective provisions that regulate issues pertaining the customer protection, the electronic commerce, the protection and privacy of personal data, the protection of intellectual or industrial property rights.
The Company reserves the right to amend or renew the Terms and it also undertakes to inform you for any amendments to and of any change thereof through the Website of this e-shop.
Any cancellation of a specific Term doesn't induce the cancellation of the other Terms. Non-exercise by the Company of its rights under these Terms does not imply a waiver of those rights.
2. SAFETY - PRIVACY OF TRANSACTIONS
All information transmitted by users to the e-shop is private. In particular, the Company uses the following mechanisms-security methods in order to safeguard your personal data and electronic transactions:
-Identification and Authorization for User Login:
In order to perform any online transaction with the Company, you have to create a personal account on our e-shop. In order to access that account, you must enter your username and password, which solely you determine and know.
-Automatic Logout:
In case you are signed in to your personal account and there is no activity for a period longer than fifteen (15) minutes (expiry time), you will be automatically logged out of your account.
-Use of SSL (Secure Sockets Layer) Technology:
It is a security communication protocol that uses a 128-bits key to encrypt sensitive information (e.g. credit card numbers, addresses, etc.) sent by your terminal, until this information reaches the e-shop proxy server where it will be encrypted. In this way your personal data are safeguarded since this protocol prevents reading or modifying it as it is transferred over Internet, and at the same time it verifies the integrity and authenticity of all transmitted information. In particular, the system used by the Company is certified by VeriSign® specialized on the security of transactions.
3. PERSONAL DATA PROCESSING & PROTECTION
"The protection of user personal data shall be governed by the General Data Protection Regulation (EU) 2016/679 and in general by the applicable national and european laws and regulations on personal data protection. 4. PROTECTION OF MINORS
Personal data of minors may be collected, used and disclosed only upon express written consent of their parents or guardians.
However, the Company will not be liable for any false data submission by the users when they fill in the user registration application.
5. INTELLECTUAL PROPERTY RIGHTS – TRADEMARKS
The entire content of the Website, including images, graphs, photographs, figures, texts, provided services, sounds, videos, names, logos, distinctive features, products and, in general, all files constitute intellectual property, registered trademarks and service marks of the Company and/or its associates and are protected according to the relevant provisions of the Greek and EU law and of the international conventions.
Therefore, any copy, republication, loading, analog/digital recording and mechanical reproduction, distribution, transmission, downloading, processing, resale, creation of derivative works or misleading of the public about the actual provider of the content of the Website is strictly prohibited.
6. USER OBLIGATIONS
You thereby accept, agree and conclude that you will have a fairly and appropriate use of our e-shop. In particular, below we are mentioning, including but not limited, your obligations:
-You undertake not to use the Website for sending, publishing or transmitting in other manners any messages that are illegal for any reason.
-You are solely responsible for maintaining the secrecy of the username and password of your account.
-Moreover, you are solely responsible for making careful use of your Account, the standard log out from the account at the end of any session, as well as for any transaction performed through your account.
-You should carefully check the provided technical information and the suitability of the products you wish to order before completing the transaction.
-You are obliged to strictly abide by the laws on the transmission of data from Greece and Europe to third countries.
7. LIMITATION OF LIABILITY
The Company may not warrant the availability of the ordered products. However, in case of non availability of the products, we pledge to inform you within a reasonable period since your order date.
The Company reserves its rights for any technical or typographical errors in the product features that have escaped its attention or occur unintentionally or are due to any downtime of the Website on grounds of force majeure.
Furthermore, the Company is liable for malice and gross negligence against users only in the event of no execution of the order or delayed delivery of the ordered products. In addition, it reserves its rights for the time of delivery in cases of force majeure (e.g. bad weather conditions, strikes, etc.).
The Company will not be liable for actual or consequential, direct or indirect damages that may be due to inability to use the Website and to errors, interruptions, defects or delays in the functioning of the Website or the transmission of information via the Website to the Internet.
The Company will not be liable for any technical problems that may arise when the users access and use the Website and are related to the compatibility of their infrastructure therewith or any "viruses" or other harmful components contained in Websites.
8. PURCHASE OF PRODUCTS
Terms of Transaction
The www.lapinkids.com e-shop operates under the provisions of Law 2251/1994 on "Consumer protection" and particularly, under resolution Ζ1-496/2000 on distance trade of goods and services.
Usage of the e-shop services doesn't involve any extra charges beyond the applied pricing scheme for the general access to Internet paid only to the relevant third providers.
The order forms and the receipts you will receive for your purchase contain any specific terms and conditions that apply additionally to the purchase of each specific product alongside the terms and conditions of this Agreement
The Company reserves the right of reservation on and/or refusal to execute orders, provided that it notifies the persons concerned of the reasons for the said reservation or refusal within a reasonable period of time.
In case of any issue, complaint, remark, etc., arising during the purchase of the products, please notify the Company promptly by calling Customer Care Center at 210 8003162, everyday from 09:00 to 17:00, or by sending email to [email protected].
Prices and other Features of the Products: The indicated prices of the products are the final values, i.e. 24% VAT included.
The Company is in anyway trying for the accurate display of data and prices for the products available through the e-shop.
However, if you find that a product is offered at an unusually low price or with unusual features, without any particular evidence that justifies such a condition, you are kindly requested to contact the Company before you proceed with your order, as there is the potential to occur typographical or technical errors in products prices and features.
Description of the Product Purchase Procedure
In order to buy products from our e-shop, you should take the following steps:
i. Select certain product codes from the product list or through the product search and add them to the purchase cart.
ii. Fill in the details of the order, e.g. payment method, shipping method, shipping address, etc.
iii. Review your whole order.
iv. Accept the Terms of Use and register the final purchase order.
In case of any errors in the above steps, select "Back" to return to the previous step and make the necessary corrections.
After the registration of your order, you'll receive an automated email containing the details of your order. After processing of your order by our Electronic Sales Department, you'll receive and second email of confirmation containing all the products to be shipped to you, as well as the tracking number of the courier service. At this point a contract is concluded between you and the Company.
Payment Methods
You have the following options to pay in full for your order:
i.Payment by credit, debit and prepaid card. In our e-shop, we accept Visa, Mastercard Maestro, American Express and Diners cards.
All payments by card are carried out through the electronic payments platform "Alpha e-Commerce" of the Alpha Bank and TLS 1.1 encryption is used with 128-bits encryption protocol (Secure Sockets Layer - SSL). Encryption is a method for encoding the information until it reaches its specific recipient who will be able to decode it by the appropriate key.
ii.Payment upon delivery to your place / Cash on delivery.
Cash on delivery does not apply to deliveries abroad. The cash on delivery cost is 2,00€.
iv. Payment via PayPal.
iii.Payment by depositing into a bank account.

9. ORDER/PRODUCTS DELIVERY/SHIPPING CHARGES
Complete order: Once you complete the order, you'll see the following message - example: "Your order is completed. Thank you. Your order number is 0000. Please check your email for the confirmation message containing the details of your order".
Products Delivery: The ordered products will be delivered within five (5) business days since the order submission date, from 09:00 to 17:00, to the address filled in the order form.
The Delivery is assumed to take place during the signing of product receipt at the agreed address. If you have indicated a third recipient for delivery/receipt, the signature thereof shall be deemed proof of receipt.
Please note that the risk of the products is transferred to you upon delivery. Therefore, upon delivery you should check the products you receive (as to the identity, integrity, condition, packaging, etc.). If you find that the products have obvious faults, sings of damage during transportation, poor packaging, etc., you should refuse receipt outset and immediately contact the Customer Care Center by calling at 210 8003162 every day from 9:00 to 17:00 or by e-mail at [email protected].
In any case, you reserve the rights provided by the applicable law.
The Company is not responsible in case of delay and/or failure to deliver due to force majeure (e.g. bad weather conditions, strikes, etc.), but must inform you so you could specify whether you wish to complete the transaction under the new conditions.
Shipping Charges: The shipping charges applied as follows:
Free delivery all over Greece
For special offers products (furniture), the shipping charges are 30€ per item to be delivered out of Attica.
10. RIGHTS FOR RETURN & WITHDRAWAL
In case you wish for any of the below mentioned reasons to return the product and for your best convenience, please contact the Customer Care Center by calling at 210-8003150 every day from 09:00 to 17:00, or by email to [email protected].
In order for the return to be valid:
- The product to be returned must be in the state it was received, i.e. it must be complete, undamaged, it may not have been used, its packaging must be the packaging that normally accompanies the product, including all labels, requisite supporting documents, instructions etc.
- The product to be returned must be accompanied by the relevant purchase documents (sales receipt, bill of lading etc.).
If the above conditions are not met, the product will be returned to you at your own expense.
Return of products should be carried out:
i.In any case, due to the Company mistake (e.g. error in ordering, at shipping, etc.) the shipped products are not those you had ordered and you received them in good faith.
The non-ordered items must be returned to the Company within five (5) days from their receipt, otherwise the Company shall not be obliged to re-execute the initial order.
ii.In case of delivery of a defective product, then you may request for its replacement with another or refund.
Since the return/replacement is due to proven defects of the product, the shipping costs for the new product or the refund costs will be borne by the Company. Please note that the Company shall be liable for compensation should the product lack the attributes specifically agreed upon or if there is a substantial defect, provided that this has been caused by Company's fault as specified in the clauses 534 et seq. of the Greek Civil Code.
iii.Should you wish to change the product with another one.
Within 30 days from the receipt of the product, you have the right to change the received product with another one of the same value you have already paid or by paying an additional sum if you wish so. Please note that any damage caused to the product while being returned to us, will be exclusively born by you. Furthermore, it is not possible for change in the product categories referred below under paragraph iv for which neither apply the right of withdrawal.
iv. Should you wish to exercise the right of withdrawal from the transaction.
You have the right to return the product without any reason and request that you be refunded the sum you paid within fourteen (14) days from the receipt of the product under the Law 2251/1994. As reception is considered the day that you or a third person you had indicated acquired the physical products. If you purchased several products within the same order and have been delivered separately, delivery date is considered the day you received the last product.
The right of withdrawal is exercised by submitting the corresponding withdrawal form that you find here or other document of relevant content and could be submitted online at: [email protected] .After having sent the corresponding document, the Company will notify you via email for the receipt of the withdrawal statement.
By exercising the withdrawal right, you are obliged to return the product to us at the specific address: 2 Achaias and Trizinias str., Postal Code 14564, Kifissia, in the perfect state delivered to you and within the same time period we are required to refund to you any amount you have paid for the purchase (value of returned product and shipping costs of the initial dispatch) using the same payment method you chosen for the execution of your initial purchase.
We may withhold reimbursement of the amount you have paid to us until we receive the product to be returned or you provide us clear and not debatable evidence that you have sent if safely (whichever occurs first).
The shipping costs of the returned product are not covered by the Company and are exclusively borne by the customer. For your faster service, we propose you return the product via Speedex, since we collaborate with this courier company.
Please note that you are not entitled for withdrawal in the cases of clause 3ΙΒ of the Law 2251/1994 and in any other event that is provided by the law or the current agreement according to the law.
In particular, under the current agreement you have no right of withdrawal for the following product categories:
-Underwear.
-Customized items/items made according to your personal requirements.
-Cosmetics
-Special price products
11. INFORMATIONAL E-MAIL (newsletters)
Regularly, our e-shop sends informational emails, containing news and information about the Company's products and special offers.
You receive the informational emails (newsletters) only if you opt for and for as long as you wish. You may opt to be removed from the recipients list of the newsletter, whenever you want, via the link contained in it. The newsletter could be identified as junk email by your email provider and moved in your Spam folder, thus we propose to save the address lapinkids.com of the sender in your safe list.
The Company sends you automated informational messages (email) regarding the progress of your order and sending of such messages is a prerequisite for the proper provision of the Company's services. For your best service, please ensure they could reach you, you save them during the whole time period of your transaction and you notify the Company without any further delay in case you don't receive them, contacting the Customer Care Center.

13. APPLICABLE LAW – JURISDICTION
These Terms and Conditions and any amendments thereto shall be governed by the law of Greece. For any dispute that may arise from the Terms hereof, the Courts of Athens are defined as competent in the matter of.
